Terms of membership

Updated [date]. These terms are the contract between you and Seatdrop Ltd ("Seatdrop", "we"), a company registered in England and Wales, company number [number], registered office [address], email hello@seatdrop.co.uk. By joining Seatdrop you agree to them. Nothing in these terms affects the rights you have as a consumer under UK law.

1. What Seatdrop is. Seatdrop is an alert and information service. We tell you about flight fares ("drops") that we have found and checked, measured against what we believe the route usually costs. We do not sell flights, hotels or any travel service, we are not a travel agent or tour operator, and we are not a party to any booking you make. When you book, your contract is with the airline or booking site, and their terms apply.

2. Membership. Free membership gives you a limited selection of drops for one airport, delayed after paid members. Premium membership gives you every drop we approve for up to three airports, the moment we approve it, plus the other features described on our pricing page. Founding membership is Premium at a fixed price for as long as your membership stays active, limited to the first 1,000 members. You must be 18 or over and give us a valid email address.

3. Price and payment. Premium costs £39 a year or £3.99 a month, and Founding £29 a year, including VAT where it applies. Payment is taken by Stripe; we never see your card number. Annual plans renew each year and monthly plans each month until you cancel. We'll email you before an annual renewal. If a payment fails we'll retry it for a short period and then move you to free membership.

4. Free trial. Premium starts with a 14-day free trial. We take your card details at the start and charge nothing unless you're still a member when the trial ends, at which point the plan you chose begins. We'll remind you three days before. You can cancel during the trial from your billing page and pay nothing.

5. Cancelling. You can cancel at any time from your billing page. Cancellation takes effect at the end of the period you've already paid for; we don't refund part-periods except under clause 6 or where the law requires it. Under the Consumer Contracts Regulations you have 14 days from joining Premium to cancel for a full refund; by starting your trial you ask us to begin the service during that period, and if you cancel after a paid period has started we may deduct a proportionate amount for the service already provided.

6. The 60-day guarantee. If, in your first 60 days of paid Premium membership, we don't send you at least one drop from an airport you had selected whose price was at least £150 below the usual price we showed with it, email us within 14 days after the 60 days end and we'll refund every payment you've made for that membership. The guarantee applies once per person. Our guarantee and refund policy gives the detail.

7. Drops are information, not advice. We check every drop against a live fare search before we send it and recheck it afterwards, but airlines change prices without notice and we can't promise any fare will still be available when you look. The "usual price" is our own estimate from recent fares we've observed; it isn't the airline's price history and we don't guarantee it. Check the full price, dates, baggage rules, passport and visa requirements and the booking site's terms before you pay. You are responsible for your booking.

8. Commission. Some links in drops and on our site are affiliate links. If you book through them, the airline or site may pay us a commission at no extra cost to you. We say so wherever such links appear. Commission never affects which drops we send; every drop is chosen on price.

9. Your account. Keep your login details to yourself. Membership is personal and can't be shared, resold or used to run a competing service. We may suspend or close an account that breaks these terms, abuses the referral scheme, or scrapes or redistributes our drops, and in that case no refund is due for any remaining period beyond what the law requires.

10. Referrals. When three people you've referred complete sign-up, you get three months of Premium added to your membership. Referred people must be real and new to Seatdrop; we may withhold rewards where we see abuse.

11. Changes. We may change these terms, the price or the features. For price rises we'll give you at least 30 days' notice by email, and the new price won't apply until your next renewal after that; Founding members' price is fixed while their membership stays active. If you don't accept a change, cancel before it takes effect.

12. Our liability. We're liable for death or personal injury caused by our negligence, for fraud, and for anything else the law doesn't let us exclude. Beyond that, because Seatdrop is an information service costing at most £39 a year, our liability to you for any loss arising from your membership is limited to the amount you've paid us in the 12 months before the claim. We aren't liable for losses caused by a booking you make with a third party, by a fare changing or disappearing, or by anything outside our reasonable control.

13. Your data. How we use your personal information is set out in our privacy policy.

14. Ending the service. We may close Seatdrop with at least 30 days' notice, in which case we'll refund the unused part of any annual membership.

15. Law and disputes. These terms are governed by the law of England and Wales and the courts of England and Wales, or of Scotland or Northern Ireland if you live there. If you have a complaint, email hello@seatdrop.co.uk and we'll answer within 14 days. Nothing here stops you using the EU or UK online dispute resolution routes or a court.
